SubZeroSoCal.com – Terms of Service
These Terms of Service (“Terms”) constitute a legally binding agreement between SubZero LA LLC, a California limited liability company doing business as SubZeroSoCal.com (“SubZeroSoCal,” “Company,” “we,” or “us”), and you (“Customer,” “you,” or “your”). These Terms govern all service calls, diagnostics, estimates, repairs, communications, payments, website usage, and related services (collectively, the “Services”).
By scheduling service, approving an estimate, signing a work order, submitting payment, communicating electronically, or otherwise engaging our Services, you acknowledge that you have read, understood, and agreed to these Terms in full.
1. Estimates, Deposits & Payments
All estimates are provided in good faith based on visible conditions and initial diagnostics. Estimates are not guarantees of final repair cost. Any deposit, diagnostic fee, scheduling fee, trip charge, or advance payment made to SubZeroSoCal.com is non-refundable. Deposits may cover time allocation, administrative processing, parts procurement, and technician scheduling. Once service has been scheduled or parts ordered, deposits are earned and may not be canceled. Payment is due upon completion of services unless otherwise agreed in writing. We reserve the right to withhold equipment reassembly, parts installation, or documentation until payment is received.
2. Diagnostic Limitations & Service Disclaimers
You acknowledge that appliance diagnostics are inherently limited and may not reveal all underlying, latent, intermittent, or cascading defects. Appliances may contain pre-existing wear, concealed damage, electrical irregularities, prior improper repairs, corrosion, or age-related deterioration. SubZeroSoCal.com is not responsible for hidden or secondary failures discovered after initial repair, pre-existing conditions not visible at time of service, food, beverage, medication, or inventory loss, power surge or voltage-related damage, environmental factors, or damage resulting from prior repairs or third-party service. Additional issues discovered during or after repair may require separate authorization and additional charges.
3. Repair Finality & Limited Warranty
All approved repairs are final once performed. SubZeroSoCal.com provides no express or implied warranty on diagnostics, labor, or parts unless explicitly stated in writing on the signed invoice or work order. Any written warranty provided applies only to the specific repair performed and does not extend to unrelated components, system-wide failures, or future malfunctions. To the fullest extent permitted by law, all implied warranties, including merchantability and fitness for a particular purpose, are disclaimed unless required under California law.
4. Cancellation & California Compliance Notice
Where applicable under California law, customers may have limited cancellation rights for certain residential service contracts. Emergency service, same-day service, and completed diagnostic services may be exempt from cancellation. Nothing in these Terms waives rights that cannot legally be waived under California Business and Professions Code or other applicable statutes.
5. Limitation of Liability
To the maximum extent permitted by law, SubZeroSoCal.com shall not be liable for loss of food, wine, medication, or stored goods; loss of business revenue or profits; loss of data; or indirect, incidental, consequential, or special damages. Total liability, if any, shall not exceed the amount paid for the specific service giving rise to the claim.
6. Independent Service Provider & Non-Affiliation
SubZeroSoCal.com is an independent appliance repair company. We are not affiliated with, authorized by, sponsored by, or endorsed by any appliance manufacturer unless explicitly stated in writing. We provide service for products manufactured by multiple premium brands including Sub-Zero, Thermador, Viking, Miele, GE Monogram, KitchenAid, Wolf, and others. References to brand names are used strictly for identification, compatibility, and descriptive purposes. Sub-Zero®, Thermador®, Viking®, Miele®, GE Monogram®, KitchenAid®, and Wolf® are registered trademarks of their respective owners. All brand names, product names, and logos remain the property of their respective holders. Use of these names does not imply official manufacturer authorization or relationship.
7. Website Use & Intellectual Property
All website content, including text, design, layout, graphics, and branding elements, is the property of SubZero LA LLC unless otherwise stated. Unauthorized copying, reproduction, scraping, or misuse of content is prohibited. Descriptive references to appliance brands constitute lawful nominative fair use.
8. SMS & Electronic Communications
By providing your phone number or email address, you consent to receive communications from SubZeroSoCal.com related to appointment confirmations, technician arrival notifications, estimates, invoices, and service updates. Message frequency may vary. Standard carrier message and data rates may apply. You may opt out of SMS communications at any time by replying STOP. We do not sell or distribute mobile numbers for marketing purposes.
9. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of California. Any dispute arising from Services provided shall be resolved through binding arbitration in Los Angeles County, California, on an individual basis only. Class actions and consolidated proceedings are waived to the extent permitted by law.
